Return and Withdrawal Policy

This Return and Withdrawal Policy outlines your rights and obligations when withdrawing from contracts with MS2 GmbH, [Insert Full Company Address], Austria. It applies to all transactions concluded via distance communication (e.g., website, email, online checkout) and to digital services and products offered by MS2 in accordance with the Austrian Consumer Protection Act (KSchG) and the EU Directive 2011/83/EU on Consumer Rights (FAGG).

1. Applicability

This policy applies exclusively to consumers as defined under § 1 KSchG. If you are acting in the course of your business or self-employed activity (i.e., a “business customer” or “entrepreneur”), no statutory right of withdrawal applies.

2. Right of Withdrawal (Widerrufsrecht)

If you purchase digital content, services, subscriptions, or goods from us via online means, you are entitled to withdraw from the contract within 14 days without stating any reason.

The withdrawal period begins:

  • For services: on the day the contract is concluded;

  • For digital content not delivered on a tangible medium: on the day of contract conclusion;

  • For physical goods: on the day you (or a third party designated by you) take possession.

3. How to Exercise Your Right

To exercise your right of withdrawal, you must notify us of your decision to withdraw from the contract by means of a clear written statement (e.g., a letter sent by post or email). You may use the sample withdrawal form below, though it is not required.

4. Effects of Withdrawal

Upon valid withdrawal:

  • We will refund all payments received from you for the relevant contract, including delivery costs (except for additional costs arising from your choice of a more expensive delivery method than our standard);

  • The refund will be made using the same payment method you used, unless otherwise agreed;

  • No fees will be charged for the reimbursement.

We will carry out the refund within 14 days from the date on which we receive notice of your withdrawal, or—if applicable—upon return of goods.

If the contract concerned the supply of digital content or services, your access will be revoked immediately upon receipt of the withdrawal notice, provided the right was not already forfeited (see Section 5).

5. Exception: Loss of Withdrawal Right for Digital Content and Services

Important Note: If the contract concerns digital content (e.g., courses, software, downloads, consulting services) not supplied on a tangible medium, you will lose your right of withdrawal if:

  • You explicitly consented to the commencement of the service or download before the 14-day withdrawal period expired, and

  • You acknowledged the loss of your withdrawal right by doing so (as required under § 18 Abs. 1 Z 11 FAGG).

Such consent is collected during the ordering process. Once activated, no refund or reversal is possible.

6. Return of Goods (if applicable)

If you receive physical goods as part of a promotional package or event, and you exercise your right of withdrawal:

  • You must return the goods to us without undue delay, and in any case within 14 days of notifying us.

  • You bear the direct cost of returning the goods unless otherwise agreed.

  • You are liable for any diminished value resulting from handling that exceeds what is necessary to establish the nature, characteristics, and functioning of the goods.

7. Exclusion of Withdrawal Rights

The right of withdrawal does not apply to the following contracts:

  • Digital content delivered electronically and not on a physical medium, once performance has begun with consumer’s express consent;

  • Services already fully performed prior to the withdrawal and where performance began with the consumer’s prior express consent;

  • Custom-built or personalized services/products;

  • Contracts with business customers or institutions;

  • Time-specific bookings (e.g., consultations, coaching sessions, live events with fixed dates).
